1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you (“Client”, “You”) and WebForAccess (“Company”, “we”, “us”, or “our”), concerning your access to and use of the webforacess.com website, as well as any web accessibility audits, consulting, and subscription services (collectively, the “Services”) provided by us. By accessing the site or engaging our Services, you agree that you have read, understood, and agree to be bound by all of these Terms and Conditions.

2. Nature of Services and Disclaimer of Legal Advice

WebForAccess provides technical accessibility auditing and remediation guidance based on the Web Content Accessibility Guidelines (WCAG) 2.2 AA standards.

No Legal Counsel: Our Services, including audit reports, VPATs (Voluntary Product Accessibility Templates), and compliance sign-off letters, represent technical evaluations and engineering recommendations. They do not constitute legal advice. We do not guarantee immunity from demand letters, lawsuits, or regulatory actions under the ADA, Section 508, the EAA, or any other jurisdiction. You are encouraged to consult with legal counsel regarding your specific compliance obligations.

3. Scope of Work and Client Responsibilities

We pride ourselves on providing highly accurate, developer-ready remediation guidance. However, the final implementation of our recommendations rests with your team.

  • Remediation Guidance: We provide annotated logs, ARIA logic, and code snippets to guide your developers. We do not directly alter, deploy, or implement code onto your live production servers unless explicitly agreed upon in a separate, custom Development Master Services Agreement.
  • Client Implementation: You acknowledge that failure to properly implement our recommended fixes, or subsequent updates made by your team after our audit, may result in continued or new accessibility barriers.
  • Access to Environments: If required for manual testing, you agree to provide timely access to staging environments or necessary credentials.

4. Subscriptions, Payments, and Deliverables

  • Audit Plans: For ongoing Services (Monthly, Quarterly, or Annual audits), the specific scope, cadence, and pricing will be outlined in your custom Service Agreement or Invoice.
  • Payments: All payments for Services must be made in accordance with the billing schedule outlined in your specific agreement. Deliverables (such as the final VPAT or Violation Report) will not be released until the associated invoice is paid in full.
  • Cancellations: Subscription plans require a 30-day written notice for cancellation prior to the next billing cycle.

5. Intellectual Property

  • Your Assets: You retain all ownership rights to your website, source code, and branding.
  • Our Methodology: WebForAccess retains all ownership of our proprietary testing methodologies, report templates, VPAT structures, and training materials. Upon full payment, you are granted a non-exclusive, non-transferable license to use the delivered audit reports and code snippets strictly for the internal remediation and legal defense of your audited digital properties.

6. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will WebForAccess, its directors, employees, or contractors be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages—including lost profit, lost revenue, or legal defense costs—arising from your use of our Services, even if we have been advised of the possibility of such damages.

Our total liability to you for any cause whatsoever will at all times be limited to the amount paid, if any, by you to us for the specific Service in the three (3) months prior to the event giving rise to the claim.

7. Modifications to the Website and Services

We reserve the right to change, modify, or remove the contents of the Site or our Service offerings at any time or for any reason at our sole discretion without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site or Services.

8. Governing Law

These Terms shall be governed by and defined following the laws of Pakistan. WebForAccess and yourself irrevocably consent that the courts of Pakistan shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
